Terms & Conditions for 1-on-1 Coaching

These Terms & Conditions are an integral part of your Coaching Contract and govern the relationship between the Coach and Client. By engaging in coaching services, the Client agrees to these Terms & Conditions. Please ensure you read and understand them thoroughly.

  1. Coach-Client Relationship

The relationship between Coach and Client is that of principal and independent contractor. This Coaching Contract does not create a joint venture, partnership, or employment relationship between the parties.

The Coach will uphold industry best practices and ethics in all interactions. However, the Client acknowledges that the Coach is not responsible for their physical, emotional, or mental well-being, and the results of the coaching are the Client’s sole responsibility.

Coaching is not therapy and does not substitute for medical or psychological treatment. The Client agrees that the Coach is not liable for any outcomes arising from actions or inactions, and they understand that coaching does not diagnose, treat, or cure any medical conditions.

The Client may terminate the coaching relationship at any time. The Client understands that coaching may involve various aspects of their life (work, finances, health, etc.), but the responsibility for decisions remains with the Client.

  1. Services

Coaching sessions last approximately 2 hours and are priced at €222 per session. Sessions are conducted via Zoom, unless otherwise arranged, and can be booked online. The services aim to support personal growth and development, but the Coach makes no guarantees regarding specific results.

  1. Payment & Fees

The Coaching Contract is effective as of the date of signing, and payment is required in advance before scheduling any sessions. Payments are non-refundable, and sessions must be rescheduled at least 48 hours in advance to avoid forfeiture. In the case of late cancellation (less than 24 hours’ notice) or a no-show, the session fee will not be refunded.

  1. Scheduling & Appointments

Clients may reschedule appointments via the online booking platform, provided changes are made at least 48 hours prior to the session. If the Client cancels or reschedules less than 24 hours before the scheduled time, the session is forfeited without refund.

If the Client arrives late for a session, the session will still end at the originally scheduled time. Zoom links for each session will be provided via email before the appointment.

  1. Confidentiality

All information shared between the Coach and Client will be treated as confidential. However, coaching does not fall under legal privilege like therapy or legal services. The Coach will not disclose any information without the Client’s written consent, except in circumstances where sharing information with other professionals may benefit the coaching process (e.g., mentoring or supervision), in which case details will remain anonymous.

Public discussion of the coaching relationship is prohibited. The Client agrees not to make public any private communication between the parties, including on social media. Violation of this may result in legal consequences.

  1. Record Keeping

The Coach may take notes during sessions to track topics discussed. These notes will not be shared with the Client and may be retained or deleted at the Coach’s discretion. Financial records will be maintained in compliance with applicable accounting and tax regulations.

  1. Termination

This contract may be terminated by the Coach if the Client repeatedly fails to follow coaching guidelines or if the relationship becomes unworkable. In such cases, the Client will receive a pro-rated refund based on the number of sessions completed. However, no refunds will be issued if the Client terminates the contract for personal reasons.

  1. Limitation of Liability & Indemnification

The Coach makes no representations or warranties regarding specific results or outcomes of the coaching process. The Client acknowledges that they are fully responsible for their own progress and actions, and the Coach is not liable for any damages, whether direct or indirect.

The Coach is not a medical professional and will not provide any medical, financial, or legal advice. The Client is advised to seek professional guidance in these areas when necessary.

  1. Dispute Resolution

In the event of a dispute, the parties agree to attempt mediation in good faith for up to 30 days. If the dispute remains unresolved, the prevailing party in any subsequent legal action shall be entitled to recover attorney fees and court costs.

  1. Severability

If any provision of this agreement is deemed invalid or unenforceable, the remainder of the Terms & Conditions shall remain in effect. Invalid provisions may be modified to maintain their enforceability within legal limits.

  1. Applicable Law

These Terms & Conditions are governed by the laws of the Netherlands, without reference to conflict-of-law principles.

  1. Binding Effect

These Terms & Conditions, together with the Coaching Contract, represent the entire agreement between the Coach and Client. No modifications shall be valid unless agreed upon in writing by both parties.
